DAKOTA COUNTY JAIL ADVISORY COMMITTEE MINUTES September 5, 2008 Jail Conference Room
PRESENT: Committee Members: Bill McLarty, Sally Reinert, Vincent Kramper and Bob Giese. Non-voting committee members: Debra Fergen, Deputy County Attorney and Scot Ford, South Sioux City Police Chief. Also present were Terry Kern, Director of Corrections, Mark Nelson, Jail Captain and Joan Spencer, Secretary. ABSENT: Committee Members: Marlin Millard. Non-voting committee members: James Wagner, Dakota County Sheriff.
The meeting was called to order at 7:30 a.m. by Chair McLarty. Roll Call was taken.
Vincent Kramper motioned, seconded by Sally Reinert, to approve the minutes of July 11, 2008, as printed. Roll Call - All aye.
Bob Giese arrived at 7:32 a.m.
Update from Terry Kern, Director of Corrections, was given: Jail Occupancy: New Facility 99 Federal 46 - Sept. 5 Old Facility 29 Work Release 7 Juvenile 2 D&E 1 House Arrest __3 Total 134
Average inmate population for the month of August, 2008, was 120. The average federal inmates held during the month of August was 42.2. Federal Marshal Service was billed $88,492.52 and year-to-date billed is $650,916.53.
Terry Kern noted that the Federal Marshal Service headquarters is still in Sioux City as a result of the flooding this spring in Cedar Rapids.
Budget related cost: CBM food contract renewal reflects a CPI (Consumer Price Index) increase of 4.6% effective January 1, 2009.
Status of Federal, BIA and ICE contracts: Federal inmates continue above projections; have not heard from BIA; and have not heard from ICE regional contact person in St. Paul.
Juvenile contract with NE Nebraska Juvenile Services in Madison is still under review. County Attorney Kim Watson told Terry Kern she felt the contract language would have the County placing all juveniles at Madison unless the court ordered them to be placed elsewhere, which the Court does not do. The Court will simply order that the juvenile be held in secured detention. Woodbury County Juvenile Detention Center is usually our first choice simply because their rates are lower ($100 a day) and it is closer than Madison and saves transportation costs and time.
Vincent Kramper asked if the contract still has the term “exclusively.” Deb Fergen said the wording has changed but the contract still reads that the county agrees to place all juveniles with Madison unless so ordered differently by the Court and that it not the way it works with the Court.
Deb Fergen also pointed out that Woodbury charges an hourly break down rate versus Madison charging a per day rate. Ms. Fergen further stated that Ms. Watson was concerned with the contract not locking in the per diem rate of $145 secured and $125 staff secure. The rate can be changed with a 30-day notice.
Terry Kern said the paperwork is in place to apply for reimbursement from the state for qualifying inmates detained in our jail. There is still a mandatory cap, but funds were available last year for 1st and 2nd quarter reimbursement.
Upcoming needs: Re-roof the courthouse and specifically the old jail. Terry Kern has contacted 3 architects to bid a generic roof spec. Weather cooperating, he hopes to re-roof at least the old jail this fall and complete the project in the spring. Chair McLarty pointed out that this is on Monday, September 8th, agenda for the Board of Commissioner’s consideration.
Vincent Kramper motioned, Sally Reinert seconded, to emphasize to the Board of Commissioners the importance of getting the job started this fall if the architect bids are reasonable. Roll Call: all aye.
Terry Kern informed the committee that 8 people will attend class this fall for jail certification. The class will be taught in the Dakota City Fire Hall. Two jailers were certified this summer in Grand Island to facilitate staffing. He hopes to have this certification training complete by October 1st.
Terry Kern stated Dakota County might be transporting federal inmates to Sioux Falls for Conair transportation per our contract. There is additional compensation if we perform this service. The new transport van has been delivered. The old van is still in use.
Sally Reinert asked the status of accreditation. Terry Kern stated he was working on changing wording on current policy.
Chair McLarty asked is there were any further questions from the committee. There were none.
Chair McLarty adjourned the meeting at 7:50 a.m.
